Terms of Service

1. Who we are

Mutalyx Community (“Mutalyx”, “we”, “us”) is a digital studio that designs and engineers premium websites, AI systems and automation. Contact: hello@mutalyx.com.

2. Scope of services

We deliver the services described in your individual proposal or statement of work — typically web platforms, AI assistants, automation and related engineering. Anything not expressly listed in the proposal is out of scope until agreed in writing.

3. Proposals, deposits and timelines

Engagements begin once scope is confirmed and the agreed deposit is received. Delivery timelines (e.g. 7, 10 or 14 days) are measured from that moment and assume timely client input (content, access, feedback). Delays in client input extend timelines accordingly.

4. Our delivery guarantee

Where we commit to a launch date in writing, we honour it or return your deposit. The guarantee applies to the originally agreed scope; out-of-scope additions are handled as separate work.

5. Payment

• One-time fees are invoiced per the proposal (typically a deposit up front and the balance at delivery).
• Monthly retainers are billed in advance and cover hosting, AI credits, security updates, minor revisions and priority support as specified.
• Invoices are due within 14 days unless stated otherwise. Late payments may pause active work and accrue statutory interest.

6. Ownership and licensing

On full payment, you own the deliverables: domain, source code and content are yours. We host on Vercel and you can migrate at any time. We retain the right to reuse non-client-specific tooling, libraries and design patterns, and — unless you object in writing — to reference the engagement in our portfolio.

7. Client responsibilities

• Provide accurate information, content and timely access to required accounts.
• Ensure you have the rights to any material you supply (text, images, logos).
• Designate one point of contact for approvals.

8. Third-party services

Our systems integrate third-party providers (e.g. Vercel, OpenAI, Stripe, Cal.com, Resend, WhatsApp). Their use is subject to their own terms, and their availability and pricing are outside our control.

9. Warranties and liability

We deliver with professional care. To the extent permitted by law, our total liability for any claim is limited to the fees paid for the engagement giving rise to the claim. We are not liable for indirect or consequential loss, or for outages of third-party services.

10. Confidentiality

Each party keeps the other’s non-public information confidential and uses it only to perform the engagement.

11. Termination

Either party may end an engagement in writing. You pay for work completed up to termination; we hand over deliverables produced and paid for. Monthly retainers can be cancelled with one month’s notice.

12. Governing law

These terms are governed by the applicable law of our place of business, with disputes submitted to the competent courts there, unless mandatory consumer law provides otherwise.
